2. Data Collection and Use

Photos Submitted for Identification

When you use Vinny, you may upload photos of vinyl records, CDs, or other music media for identification purposes. These photos are transmitted to an artificial intelligence service for analysis.

No Data Storage

The Company does not store uploaded photos or personal data on its own servers. Images are used solely for processing and are not retained by us after the identification request is completed.

No Tracking or Analytics

Vinny does not collect user analytics, tracking information, or behavioral data.

3. Data Processing by Third Parties

AI Processing

Photos submitted through the application are processed by OpenAI via its API in order to generate identification results.

OpenAI processes this data under its own policies and terms. We recommend reviewing OpenAI’s privacy policy to understand how they handle data processed through their services.

No Commercial Data Sharing

The Company does not sell, rent, or share personal data with third parties for advertising, profiling, or marketing purposes.

4. Legal Basis for Processing

Where the General Data Protection Regulation (GDPR) applies, data processing occurs on the basis of:

  • Performance of a service requested by the user (Art. 6(1)(b) GDPR), specifically identifying a music record from a submitted image.
  • Legitimate interests (Art. 6(1)(f) GDPR) in operating and maintaining the functionality of the application.

5. Your Rights Under GDPR

If you are located within the European Economic Area, you have the following rights regarding your personal data:

  • Right of Access – to request confirmation of whether personal data concerning you is processed.
  • Right to Erasure – to request deletion of personal data where applicable.
  • Right to Restrict Processing – to request limitations on how data is processed.
  • Right to Object – to object to processing based on legitimate interests.

Because Vinny does not store personal data on Company servers, in many cases we may not retain any data that can be accessed or deleted.

6. Data Security

Appropriate technical measures are used to protect data during transmission.

  • Communication between the application and external processing services is encrypted using secure protocols.
  • Images submitted through the app are transmitted only for processing and are not stored by the Company.

7. Third-Party Services

Vinny relies on external infrastructure for AI-based identification.

Specifically, images are processed using OpenAI’s API. OpenAI may process submitted images according to its own privacy policies and data retention practices.

The Company does not control the independent policies of third-party service providers.

8. Children’s Privacy

Vinny is not directed toward children under the age of 13.

If we become aware that personal data from a child under 13 has been processed without appropriate consent, we will take reasonable steps to delete such data where possible.

9. Changes to This Privacy Policy

This Privacy Policy may be updated periodically to reflect legal, technical, or operational changes.

When updates occur, the “Last Updated” date at the top of this document will be revised. Continued use of the application after updates become effective constitutes acceptance of the revised policy.
