This Privacy Policy explains how Chart Analyser (“Chart Analyser”, the “App”) processes information when you use the App.

For the purposes of applicable data protection law, including the General Data Protection Regulation (“GDPR”), Trusted Brands UG (haftungsbeschränkt) is the controller responsible for the processing described in this Privacy Policy.
1. Overview
Chart Analyser is designed with data minimization in mind. Most information created or used within the App is stored locally on your device and is not transmitted to or stored on servers operated by Trusted Brands UG (haftungsbeschränkt).
However, when you actively request the analysis of a stock, cryptocurrency, trading or other financial chart, the image of that chart must be transmitted to an external artificial intelligence service in order to perform the requested analysis.
At the time of this Privacy Policy, Chart Analyser uses the OpenAI API for this analysis.
The chart image and information technically necessary to process the request are therefore transmitted to OpenAI for the limited purpose of generating the requested chart analysis.
2. Information Stored Locally on Your Device
Except for information that must be transmitted for AI-powered chart analysis as described below, Chart Analyser is designed to keep application data locally on your device.
This may include, depending on the features you use:
- previous chart analyses;
- analysis results;
- saved charts;
- application settings;
- preferences;
- locally generated application data; and
- other information created while using the App.
This locally stored information is not routinely transmitted to Trusted Brands UG (haftungsbeschränkt).
Deleting the App may also delete locally stored App information, depending on the storage mechanisms provided by your device and operating system.
3. Chart Images Submitted for Analysis
The core functionality of Chart Analyser allows you to take or select an image containing a stock chart, cryptocurrency chart or similar market chart and request an automated analysis.
When you request an analysis, the selected image is transmitted from your device to the OpenAI API so that artificial intelligence models can interpret the image and return an analysis to the App.
The transmission occurs only when you actively initiate an analysis.
Trusted Brands UG (haftungsbeschränkt) does not operate a separate database for the purpose of permanently storing your submitted chart images.
The image is transmitted to the third-party AI service because remote processing is technically necessary to provide the chart-analysis functionality requested by you.
4. Information That May Be Contained in Chart Images
Chart Analyser is intended for images of financial charts. However, the App cannot control everything that may appear in an image selected or captured by a user.
A screenshot or photograph could potentially contain additional information such as an account name, portfolio value, balance, transaction information, device information, notifications or other personal or financial information.
You should therefore review an image before submitting it for analysis and avoid submitting images that contain personal, confidential, sensitive or unnecessary information.
Where possible, crop or remove information that is not required for the chart analysis.
5. Use of OpenAI
Chart Analyser uses artificial intelligence technology provided through the OpenAI API.
For the purpose of performing a requested chart analysis, information may be transmitted to and processed by:

and, where applicable, OpenAI affiliates and subprocessors involved in providing the OpenAI API infrastructure.
The transmitted information may include:
- the chart image submitted by you;
- instructions necessary to analyze the chart;
- technical request information required to communicate with the API; and
- the resulting AI-generated analysis.
OpenAI processes this information for the purpose of providing the requested artificial intelligence service, maintaining the security and reliability of its systems, detecting abuse and complying with applicable legal obligations.
According to OpenAI’s policies applicable to its API services, inputs and outputs submitted through the OpenAI API are not used to train or improve OpenAI’s models by default unless the API customer explicitly opts into such data sharing.
Trusted Brands UG (haftungsbeschränkt) does not intentionally opt in to the use of Chart Analyser user submissions for model training.
OpenAI states that API data may, depending on the endpoint, account configuration and applicable service settings, be retained for a limited period for security and abuse-monitoring purposes. Under OpenAI’s standard API data controls, abuse-monitoring data may generally be retained for up to 30 days, unless longer retention is required by law or another applicable exception applies.

6. Purpose of Processing
Chart images are processed solely for the purpose of providing the functionality requested by you, in particular:
- recognizing information displayed in a chart;
- identifying technical chart structures and patterns;
- generating an AI-based interpretation of the chart;
- returning the analysis to the App; and
- maintaining the technical security and functionality of the service.
We do not sell submitted chart images.
We do not use submitted chart images for advertising.
We do not use submitted chart images to create advertising profiles about you.
We do not use submitted chart images to track you across apps or websites owned by other companies.
7. Legal Basis for Processing
For users located in the European Economic Area (“EEA”), Switzerland or other jurisdictions in which the GDPR or similar laws apply, processing that is necessary to perform the chart analysis requested by you is generally based on Article 6(1)(b) GDPR.
The processing is necessary in order to provide the App functionality that you specifically request when you submit a chart for analysis.
Where processing is necessary for security, prevention of abuse, protection of our services or establishment, exercise or defense of legal claims, processing may additionally be based on our legitimate interests pursuant to Article 6(1)(f) GDPR.
8. Camera and Photo Access
Chart Analyser may request access to your device’s camera in order to allow you to photograph a chart.
If the App provides the ability to select an existing image, it may also request access to photos that you choose from your photo library.
These permissions are used only to provide the respective functionality requested by you.
Chart Analyser does not automatically upload your entire photo library.
Only the image that you select or capture and submit for analysis is transmitted for AI processing.
You can manage camera and photo permissions at any time through the privacy settings of your device.
9. No User Account Required
Unless explicitly indicated otherwise within a future version of the App, Chart Analyser does not require you to create a personal user account with Trusted Brands UG (haftungsbeschränkt) in order to use its core functionality.
We therefore do not intentionally collect names, postal addresses, telephone numbers or email addresses through the normal chart-analysis functionality.
10. Device Data and Local Processing
Information that remains exclusively on your device is not accessed or collected by Trusted Brands UG (haftungsbeschränkt) merely because it is stored or processed by the App.
Operating system features provided by Apple may independently process certain technical information in accordance with Apple’s own terms and privacy policies. Such processing by Apple is outside the control of Trusted Brands UG (haftungsbeschränkt).
11. International Data Transfers
The infrastructure used to provide artificial intelligence processing may involve processing in countries outside your country of residence.
For users in the European Economic Area or Switzerland, OpenAI’s applicable data-processing arrangements provide mechanisms intended to protect personal data when information is transferred internationally.
Where personal data is transferred to countries for which the European Commission has not issued an adequacy decision, appropriate safeguards may include the Standard Contractual Clauses approved by the European Commission in accordance with Article 46 GDPR.
12. Data Retention
Data Stored by Chart Analyser
Information stored locally within Chart Analyser generally remains on your device until you delete the relevant information, reset the App or delete the App, subject to the normal behavior of your operating system and device backups.
Chart Images Submitted for AI Analysis
Trusted Brands UG (haftungsbeschränkt) does not maintain a separate permanent archive of chart images submitted through the App for AI analysis.
Images submitted to OpenAI are subject to OpenAI’s API data-processing and retention practices.
Under OpenAI’s standard API data controls, certain API inputs and outputs may be retained for up to 30 days for purposes such as abuse and security monitoring, unless a different retention configuration applies or retention is required by law.
13. Sharing of Information
We do not sell your personal data.
Information is disclosed to third parties only where necessary to provide the requested functionality, operate or secure the service, comply with applicable law or protect legitimate legal interests.
For the chart-analysis feature, the primary third-party processor is OpenAI and its authorized subprocessors involved in providing the API service.
Service providers acting on our behalf are required to process information in accordance with applicable contractual and data-protection obligations.
14. Automated Analysis and Accuracy
Chart Analyser uses artificial intelligence to interpret images and generate information about chart structures and patterns.
The output is generated automatically and may be incomplete, inaccurate or incorrect.
AI-generated chart analysis is provided for informational and educational purposes and should not be treated as guaranteed information, investment advice, financial advice or a recommendation to buy, sell or hold any financial instrument or cryptocurrency.
No solely automated decision with legal or similarly significant effects concerning you is made by Trusted Brands UG (haftungsbeschränkt) based on the chart images you submit.
15. Security
We take reasonable technical and organizational measures designed to protect information processed through Chart Analyser against unauthorized access, alteration, disclosure, loss or misuse.
Communication with remote service providers is transmitted using encrypted network connections where supported by the applicable services and infrastructure.
Nevertheless, no electronic transmission or information-processing system can be guaranteed to be completely secure.
16. Your Data Protection Rights
If the GDPR applies to you, you may have the following rights regarding personal data processed by us:
- Right of access under Article 15 GDPR;
- Right to rectification under Article 16 GDPR;
- Right to erasure under Article 17 GDPR;
- Right to restriction of processing under Article 18 GDPR;
- Right to data portability under Article 20 GDPR;
- Right to object under Article 21 GDPR; and
- Right to withdraw consent under Article 7(3) GDPR where processing is based on consent.
Because most Chart Analyser information is stored exclusively on your device and is not accessible to us, we may not possess or be able to identify locally stored information about you.
You can delete locally stored information directly within the App where such functionality is available, or by deleting the App from your device.

17. Right to Lodge a Complaint
If you believe that the processing of your personal data infringes applicable data-protection law, you have the right to lodge a complaint with a competent data-protection supervisory authority.
You may generally contact the supervisory authority responsible for your habitual residence, place of work or the location of the alleged infringement.
18. Children’s Privacy
Chart Analyser is not designed for the purpose of collecting personal information from children.
We do not knowingly request that children provide personal information through the chart-analysis functionality.

19. Changes to This Privacy Policy
We may update this Privacy Policy from time to time, for example when the functionality of Chart Analyser changes, when service providers change, or when legal or regulatory requirements change.
The current version will be made available through the App and/or on our website.
The date shown at the top of this Privacy Policy indicates when it was last updated.
