These Terms and Conditions (“Terms”) govern your access to and use of the mobile application Chart Analyser (“Chart Analyser”, the “App”).

In these Terms, “we”, “us” and “our” refer to Trusted Brands UG (haftungsbeschränkt).
By downloading, accessing or using Chart Analyser, you agree to these Terms. If you do not agree to these Terms, you must not use the App.
1. Description of Chart Analyser
Chart Analyser is a software application that allows users to submit images or screenshots of financial market charts, including stock, cryptocurrency and other market charts, for automated analysis.
The App may use artificial intelligence and other automated technologies to identify, describe or interpret information such as:
- chart structures;
- technical patterns;
- price movements;
- support and resistance areas;
- trend structures;
- technical indicators;
- possible market scenarios; and
- other visually identifiable characteristics of financial charts.
The App is intended to provide informational, analytical and educational assistance only.
2. No Financial or Investment Advice
Chart Analyser does not provide financial, investment, trading, tax, legal or professional advice.
Nothing generated, displayed or communicated through Chart Analyser constitutes or should be understood as:
- investment advice;
- financial advice;
- a recommendation to buy, sell or hold an asset;
- a personalized investment recommendation;
- portfolio management;
- brokerage services;
- investment research intended to meet regulatory standards;
- a guarantee of future market performance; or
- an offer, solicitation or invitation to buy or sell any financial instrument, security, cryptocurrency or other asset.
The App is not a bank, broker, investment firm, financial adviser, portfolio manager, cryptocurrency exchange or trading venue.
Trusted Brands UG (haftungsbeschränkt) does not execute transactions on your behalf, hold customer assets, manage investment portfolios or provide individualized financial planning through Chart Analyser.
3. AI-Generated Analysis
Chart Analyser uses artificial intelligence and automated systems to generate analyses.
Artificial intelligence systems are probabilistic technologies and can produce results that are incomplete, inaccurate, outdated, misleading or incorrect.
An analysis may, for example:
- incorrectly identify a chart pattern;
- misread prices, labels, indicators or timeframes;
- misinterpret the asset displayed;
- fail to recognize relevant market information;
- make incorrect assumptions about the chart;
- produce inconsistent results from similar charts; or
- describe possible scenarios that never occur.
You must independently evaluate and verify any information generated by the App before relying upon it.
You should never make a financial decision solely on the basis of information generated by Chart Analyser.
4. No Prediction or Guarantee of Market Performance
Financial markets are inherently uncertain.
Historical chart patterns, technical indicators, price movements and market structures do not guarantee future results.
Even where the App identifies a recognized technical pattern, the future price of the relevant asset may behave completely differently from historical examples or expected technical outcomes.
We make no representation or warranty that:
- an identified pattern will result in a particular market movement;
- a price target will be reached;
- a support or resistance level will hold;
- a trend will continue;
- a trade will be profitable;
- a market prediction will be correct; or
- use of Chart Analyser will result in profits or prevent losses.
5. Trading and Cryptocurrency Risk
Trading stocks, cryptocurrencies, derivatives and other financial instruments can involve substantial risk.
The value of financial assets can rise or fall rapidly and you may lose some or all of the money you invest.
Cryptocurrency markets can be particularly volatile and may be affected by technological, regulatory, liquidity, cybersecurity and market risks.
Certain financial products, including leveraged products, options, futures, contracts for difference and margin trading, may expose users to particularly high levels of risk.
You are solely responsible for deciding whether any investment, transaction or trading strategy is appropriate for you.
Where appropriate, you should consult a qualified and authorized financial professional before making significant financial decisions.
6. User Responsibility
You remain solely responsible for all decisions and actions you take based on information obtained through the App.
This includes, without limitation:
- investment decisions;
- trading decisions;
- buying or selling assets;
- position sizing;
- use of leverage;
- stop-loss or take-profit decisions;
- portfolio allocation;
- risk management; and
- decisions not to take a particular action.
You acknowledge that Chart Analyser is only one possible analytical tool and should not replace your own research, independent judgment or professional advice.
7. Chart Images and Input Quality
The accuracy and usefulness of an analysis may depend significantly on the quality and completeness of the image submitted to the App.
For example, an analysis may be less reliable where:
- the image is blurry or cropped;
- important chart information is missing;
- the timeframe is not visible;
- the asset is not identifiable;
- prices or indicators are obscured;
- the chart contains unusual or proprietary indicators;
- the screenshot has been edited or manipulated; or
- the AI system incorrectly interprets visual information.
You are responsible for checking whether the information presented in the submitted image is sufficient and accurate.
8. Market Data
Chart Analyser primarily analyses information contained in the image or chart submitted by you.
Unless expressly stated otherwise within the App, an analysis should not be assumed to incorporate live market prices, current financial news, company announcements, economic data, order-book information or other real-time market information.
A chart image may already contain delayed, outdated or inaccurate information before it is submitted to the App.
You should independently verify current prices and market information using appropriate sources before making financial decisions.
9. Image Processing and Third-Party Artificial Intelligence
When you submit a chart for analysis, the selected chart image and information necessary to process your request may be transmitted to third-party artificial intelligence infrastructure.
Chart Analyser currently uses technology provided through the OpenAI API to perform certain artificial intelligence analyses.
Third-party services may process information in accordance with their applicable contractual terms and privacy requirements.
Further information about the processing of chart images and other information is provided in the Chart Analyser Privacy Policy.
10. Your Content
You may submit photographs, screenshots or other images to Chart Analyser (“User Content”).
You retain any rights you hold in your User Content.
By submitting User Content for analysis, you authorize us and the service providers necessary to operate the App to process that User Content solely to the extent necessary to provide, secure and operate the requested functionality.
You represent and warrant that you have the necessary rights or permission to submit the User Content and that your submission and use of that content does not unlawfully infringe the rights of another person.
11. Sensitive Information in Screenshots
You should inspect screenshots and photographs before submitting them to Chart Analyser.
Financial application screenshots can sometimes contain information unrelated to the chart, including:
- account names;
- portfolio values;
- account numbers;
- transaction histories;
- balances;
- email addresses;
- notifications; or
- other confidential or personal information.
You should crop, obscure or remove information that is not required for the requested chart analysis.
You must not intentionally submit passwords, authentication credentials, private keys, cryptocurrency seed phrases or other security credentials to Chart Analyser.
12. Acceptable Use
You agree to use Chart Analyser only for lawful purposes and in accordance with these Terms.
You must not:
- use the App in violation of applicable law or regulation;
- attempt to gain unauthorized access to the App, its infrastructure or related systems;
- interfere with or disrupt the security or operation of the App;
- use automated systems to place an unreasonable burden on our infrastructure;
- circumvent technical usage limitations, access controls or security mechanisms;
- reverse engineer, decompile or disassemble the App except to the extent expressly permitted by mandatory law;
- use the App to distribute malware or harmful code;
- submit content that you do not have the legal right to process;
- use the App for fraudulent or deceptive purposes; or
- misrepresent AI-generated analysis as regulated professional financial advice provided by Trusted Brands UG (haftungsbeschränkt).
13. Intellectual Property
The App, including its software, user interface, design, graphics, branding, logos, text and other proprietary elements, is owned by or licensed to Trusted Brands UG (haftungsbeschränkt) and is protected by applicable intellectual property laws.
Except where expressly permitted by law or these Terms, you may not copy, modify, distribute, sell, license, reproduce or commercially exploit any proprietary part of the App.
Nothing in these Terms transfers ownership of Chart Analyser or our intellectual property to you.
14. License to Use the App
Subject to these Terms and the applicable rules of the platform through which you obtained the App, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use Chart Analyser for its intended purposes.
The App is licensed, not sold.
Where Chart Analyser is downloaded through the Apple App Store, use of the App is additionally subject to the applicable Apple Media Services terms and Apple’s Licensed Application End User License Agreement unless a valid custom license agreement applies.
15. Purchases, Subscriptions and Premium Features
Chart Analyser may offer paid functionality, premium features, subscriptions or other in-app purchases.
The specific price, subscription duration and benefits of a purchase are displayed within the App before the transaction is completed.
Where a purchase is made through Apple’s App Store, the transaction is processed by Apple and is additionally subject to Apple’s applicable payment and App Store terms.
We do not directly control the payment processing performed by Apple.
16. Automatically Renewing Subscriptions
If Chart Analyser offers an automatically renewing subscription, the subscription renews automatically for the applicable subscription period unless it is cancelled in accordance with the terms shown at the time of purchase and the rules of the applicable App Store.
Where the subscription is purchased through Apple, subscription management, renewal and cancellation are handled through your Apple ID and App Store subscription settings.
Deleting Chart Analyser from your device does not necessarily cancel an active subscription.
You are responsible for cancelling a subscription through the relevant App Store account if you no longer wish for it to renew.
17. Prices and Changes to Paid Services
Prices for subscriptions, purchases or other paid features may vary by country, currency, tax treatment or App Store territory.
The applicable price is the price displayed to you through the App Store or within the purchase interface before you confirm a transaction.
We may change the availability, functionality or pricing of paid services in the future, subject to applicable law and the requirements of the relevant App Store.
18. Refunds
Purchases made through the Apple App Store are generally subject to Apple’s billing and refund procedures.
Where Apple acts as the payment provider or merchant for a transaction, refund requests may need to be submitted directly to Apple.
Nothing in these Terms limits any refund, withdrawal, warranty or consumer right that cannot lawfully be excluded.
19. Free Trials and Promotional Offers
From time to time, Chart Analyser may offer free trials, introductory prices or promotional access.
Any applicable duration, eligibility requirement, renewal price and other material conditions will be displayed before the relevant offer is activated.
Unless otherwise stated, a trial associated with an automatically renewing subscription may convert into a paid subscription after the trial period ends unless it is cancelled in accordance with the applicable App Store rules.
20. Availability of the App
We aim to keep Chart Analyser available and functional but do not guarantee uninterrupted or error-free operation.
The App may temporarily become unavailable due to:
- maintenance;
- technical failures;
- network problems;
- third-party service outages;
- artificial intelligence provider outages;
- App Store or operating system changes;
- security incidents; or
- circumstances outside our reasonable control.
We may update, modify, improve, replace or discontinue individual functions where reasonably necessary, subject to applicable law.
21. Changes to AI Models and Analysis
Artificial intelligence technology evolves continuously.
We may change the models, providers, prompts, processing methods, algorithms or technical infrastructure used to generate analyses.
As a result, analyses produced by different versions of Chart Analyser may differ even when similar images are submitted.
We do not guarantee that a particular AI model, analysis style, feature or output format will remain available permanently.
22. Third-Party Services
The App may rely on third-party services, infrastructure, operating systems, application programming interfaces or artificial intelligence providers.
These services are outside our complete control and may be modified, interrupted or discontinued by their respective providers.
Where your use of a third-party service is subject to separate terms, you are responsible for complying with those terms.
23. No Warranty Regarding Analysis Results
To the maximum extent permitted by applicable law, Chart Analyser and its AI-generated outputs are provided on an “as available” basis.
We do not guarantee the correctness, completeness, reliability, timeliness or suitability of any individual analysis.
In particular, we do not warrant that:
- every chart will be interpreted correctly;
- every pattern will be identified;
- identified patterns will be valid;
- predicted or possible scenarios will occur;
- the App will be available without interruption;
- the App will be entirely free from errors; or
- use of the App will produce any particular financial result.
Nothing in this section excludes statutory warranties or consumer rights that cannot legally be excluded.
24. Limitation of Liability
We are liable without limitation where liability is mandatory under applicable law, including for damage caused intentionally or through gross negligence and, where required by law, for injury to life, body or health.
In cases of ordinary negligence involving the breach of an essential contractual obligation, our liability is limited, to the extent legally permissible, to damage that was reasonably foreseeable and typical for this type of agreement.
An essential contractual obligation is an obligation whose performance is necessary for the proper execution of the agreement and on whose performance the user may ordinarily rely.
To the extent permitted by applicable law, we are not responsible for financial losses resulting from investment or trading decisions made by a user in reliance on AI-generated analysis.
In particular, Chart Analyser does not assume responsibility for:
- trading losses;
- investment losses;
- lost profits;
- missed investment opportunities;
- market movements;
- liquidations or margin calls;
- incorrect trades;
- losses resulting from inaccurate or incomplete chart information; or
- decisions based on an AI-generated interpretation.
The limitations in these Terms do not apply where liability cannot lawfully be limited or excluded.
25. Consumer Rights
Nothing in these Terms is intended to restrict rights granted to consumers under mandatory applicable consumer protection law.
If you are a consumer residing in the European Union, European Economic Area or another jurisdiction with mandatory consumer rights, you retain those rights regardless of any conflicting provision of these Terms.
26. Privacy
Your use of Chart Analyser is also subject to our Privacy Policy.
The Privacy Policy explains, among other things, how chart images are processed when submitted for artificial intelligence analysis and which information remains locally on your device.
You should review the Privacy Policy before using the App.
27. Suspension or Termination
We may restrict or terminate access to Chart Analyser where reasonably necessary, including where a user materially violates these Terms, abuses the service, attempts to compromise its security or uses the App unlawfully.
Termination of access does not affect rights or obligations that arose before termination.
If you no longer wish to use Chart Analyser, you may stop using and delete the App.
If you have an active paid subscription, deleting the App alone may not cancel that subscription. You must cancel the subscription through the relevant App Store account where required.
28. Updates to These Terms
We may update these Terms where reasonably necessary, for example because:
- the functionality of Chart Analyser changes;
- new features are introduced;
- our technical infrastructure changes;
- third-party services change;
- legal or regulatory requirements change; or
- the Terms require clarification or correction.
The latest version will be made available through the App and/or on our website.
Where required by applicable law, we will provide appropriate notice before material changes become effective.
29. Apple App Store
If you obtain Chart Analyser through Apple’s App Store, you acknowledge that your use of the App is also subject to Apple’s applicable App Store terms.
Chart Analyser is provided by Trusted Brands UG (haftungsbeschränkt), not by Apple.
To the extent required under the applicable App Store arrangements, Apple has no responsibility for providing maintenance or support services for Chart Analyser.
Questions, complaints or claims specifically concerning Chart Analyser should be directed to Trusted Brands UG (haftungsbeschränkt).
You must also comply with applicable third-party terms when using the App.
30. Export and Legal Compliance
You may not use or export the App in violation of applicable export-control, sanctions or trade laws.
You represent that you are legally permitted to use the App in your jurisdiction and are not prohibited from doing so under applicable sanctions or export-control rules.
31. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by applicable law.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections provided by the law of the country in which you have your habitual residence where those protections apply regardless of the chosen law.
32. Jurisdiction
Where the user is a merchant, a legal entity under public law or a special fund under public law, the competent courts at our registered place of business shall have jurisdiction to the extent permitted by law.
For consumers, statutory rules regarding jurisdiction remain unaffected.
33. Severability
If any individual provision of these Terms is or becomes invalid, unenforceable or ineffective, the validity of the remaining provisions shall not be affected.
Mandatory statutory law applies in place of any invalid or unenforceable provision where required.
34. Entire Agreement
These Terms, together with the Privacy Policy and any applicable App Store terms, constitute the contractual framework governing your use of Chart Analyser, subject to mandatory applicable law.
